Tabania AI Comprehensive Terms and Conditions of Use

Welcome to Tabania AI, an all-in-one generative ecosystem and a subsidiary of Tabania.com. These Terms and Conditions govern your access to and use of our suite of tools, including task automation, image creation, content generation, text-to-speech (TTS), speech-to-text (STT), and our proprietary library of customizable templates.

1. Universal Acceptance and Scope

By accessing any part of the Tabania AI ecosystem, you acknowledge that you have read, understood, and agreed to be bound by these Terms. This agreement is between you (the "User") and Tabania AI/Tabania.com ("the Company").

Software as a Service (SaaS): You acknowledge that you are being granted a revocable, non-exclusive license to use the platform; you are not "purchasing" the software or the underlying AI models.

2. Specific Service Terms

2.1 Task Automation & AI Agents

Tabania AI allows users to deploy "Agents" to automate digital workflows.

Authorization: By using automation tools, you represent that you have the authority to permit Tabania AI to interact with any third-party accounts or data sources you connect.
Non-Interference: You may not use automation to disrupt the services of others, including "denial of service" attacks or mass-spamming.
Assumption of Risk: You are responsible for the actions of your automated workflows. Tabania AI is not liable for unintended deletions, API rate-limit bans, or financial losses incurred through automated trading or business processes.

2.2 Image Creation & Visual Media

Ethical Constraints: You agree not to generate images that depict child exploitation, extreme gratuitous violence, or non-consensual sexual content (NCII).
Public Figures: We reserve the right to block prompts that attempt to generate the likeness of political figures or celebrities to prevent the spread of misinformation.

2.3 Text-to-Speech (TTS) and Voice Synthesis

Voice Rights: You may not upload audio samples of individuals to "clone" their voice without their express, written, and verifiable consent.
Labeling: Tabania AI reserves the right to embed invisible digital watermarks or audio "metadata signatures" into TTS output to identify it as AI-generated. You agree not to attempt to strip this metadata.

2.4 Customizable Templates

Our templates are provided to expedite your workflow. While you may modify these for your own use, you may not "scrape" our entire template library to create a competing template marketplace.

3. Intellectual Property and Content Ownership

3.1 Our Proprietary Technology

The algorithms, model weights, training methodologies, and the "Tabania AI" brand are the exclusive property of Tabania.com. You shall not:

Decompile or "reverse-prompt" the system to extract system instructions.
Use "adversarial attacks" to bypass safety filters or extract the training data.

3.2 Your Content (Input and Output)

Ownership: You own the Output to the extent permitted by law.
License to Us: You grant Tabania AI a non-exclusive, royalty-free, worldwide license to use your Input and Output to maintain, protect, and improve our AI models.
Attribution: While not required, we appreciate attribution to Tabania AI when sharing generated content publicly. However, you must not represent that AI-generated content was purely human-authored if doing so would be deceptive.

4. Safety, Ethics, and Moderation

4.1 Content Moderation

Tabania AI utilizes automated filters to detect and block harmful content. You acknowledge that these filters may occasionally produce "false positives" and block legitimate prompts.

4.2 Reporting

If you discover a vulnerability or find that the AI is generating harmful/illegal content, you are encouraged to report it to safety@tabania.ai.

4.3 Mandatory Disclosure

In certain jurisdictions, law may require that you disclose that content was "AI-Generated" when used in political advertising, news reporting, or legal proceedings. Compliance with these local laws is your sole responsibility.

5. Financial Terms

5.1 "Free" Tier Limitations

Our free tier is provided at our discretion. We reserve the right to throttle usage, limit output quality, or display advertisements to support the high compute costs of generative AI.

5.2 Paid Subscriptions and Credits

Billing: Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
No Refunds: Due to the immediate consumption of GPU resources required for AI generation, we do not offer refunds for "used" credits or partial subscription months.

6. Disclaimers and Legal Protections

6.1 No Professional Advice

Output from Tabania AI (medical, legal, financial, or technical) is for informational purposes only. It is not professional advice. Always consult a qualified human professional.

6.2 Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TABANIA AI DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE 100% UPTIME.

6.3 Limitation of Liability

In no event shall Tabania.com, its directors, or employees be liable for any "loss of data," "loss of profits," or "system downtime" exceeding the amount you paid to Tabania AI in the last three months.

7. Indemnification

You agree to defend and indemnify Tabania AI against any third-party claims arising from:

Your use of the platform in violation of these Terms.
Any Output you generate that infringes on a third party's trademark or copyright.
Any harm caused by an "Agent" or automation workflow you deployed.

8. General Provisions

8.1 Choice of Law

These terms are governed by the laws of The Netherlands.

8.2 Dispute Resolution

Any dispute shall first be attempted to be settled via mediation. If mediation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of [Delaware, United States].
